TulipArt Designs values your privacy and is committed to handling your data securely in compliance with the General Data Protection Regulation. Our privacy statement outlines the information we collect, the reasons behind it, and clarifies your rights regarding this process. Who am I?

TulipArt Designs operates as a sole proprietorship, situated at Schrijnwerkerstraat 100, 3123EK Schiedam. Registered under number 85766925 in the Chamber of Commerce trade register, I am the controller of your personal data.

What data do I need to use?

Here you can find an overview of the data that I process about you, why I do this, what legal basis I have for processing this data about you and how long I will keep this data.

I process your name, any company name, address, place of residence, e-mail address, any telephone number and other data that are necessary to optimally provide my services to you. This includes personal data and other information that is important for the execution of the agreement. I keep this data for 7 years after the end of our agreement.

When you place an order in the webshop, I process your name, billing address, delivery address, e-mail address, telephone number, payment details, any personal message and purchase history. I keep this data for 7 years after your last order.

I process a password for your personal account after an order in the webshop. I store this password encrypted in combination with your email address and/or username. I do this to prevent security fraud. Creating an account is completely voluntary. I also process the information you enter in your account to make any subsequent orders easier. I will keep this account information until you delete your account. You can do this at any time in your personal environment.

I use a portfolio on my website and social media channels to show previous work to potential clients. I process the content created for you with, if desired, your name and any company name if you have given permission for this when entering into the agreement. I will keep this content in my portfolio indefinitely, unless you request its removal, after which a weighing of interests will take place or I will clean up my archive. You are responsible for making a backup after delivering the files.

For invoicing and financial administration, I process your name, any company name with associated Chamber of Commerce details and VAT number, customer number, address, e-mail address, telephone number, bank details and outstanding balance. Without this information I cannot process your payment. According to a legal obligation from the Tax Authorities, I must keep this data for 7 years. After this period I will delete or anonymize this data from you.

If you unexpectedly have a complaint about my services, I will process your name, e-mail address, telephone number, account number and order number and the content of and communication regarding this complaint in order to achieve the best possible solution for you. I use this information for optimal execution of the agreement. I will delete data relating to complaints 1 year after settlement.

If I discover an infringement of my copyright, I will build a file containing, among other things, screenshots of the infringement, your name and any company name, address details in connection with the possible sending of a demand letter and other relevant information that may be important for the handling the infringement. I will delete this data no later than one year after the infringement has been completed.

I have a commercial interest in using some of your personal data for marketing purposes. I process your name and email for direct marketing. Optionally, you can also enter your date of birth. I will delete this data as soon as you unsubscribe from my newsletter. You can do this at the bottom of every newsletter sent.

To enable posting reviews about my services, I process the content of your message with your (user) name if desired. I can post reviews about my services on my website and social media channels for commercial reasons. I will remove these as soon as they are no longer representative of my services or you request their removal.

If you want to contact me via the website, I will ask for your name and email address. When you send the contact form, this information becomes visible to me. I will delete the data from a sent contact form as soon as the contact request has been completed, unless an agreement results from this.

I use analytics services to enable and optimize this website. These services use cookies. You can read more about this in my cookie statement.

Finally, I process a password for your personal account in the academy when taking an online course. I store this password encrypted in combination with your email address and/or user name. In addition, I process the information you enter yourself, your billing information and any messages you post in the community in this account. These messages can also be viewed by the platform on which I host the academy. I will keep this account information until you delete your account.

How do I gather this information?

The information mentioned above is acquired through your direct provision as a customer or website visitor.

Additionally, data may be sourced from my customers during the agreement's execution, such as when providing illustrations or sending gifts (vouchers) to you.

I prioritize obtaining data about minors with parental consent. If you believe I've collected personal information from a minor without consent, kindly reach out to me.

What are your data rights?

The General Data Protection Regulation grants you specific rights regarding the personal data processed by us:

1. Inspection - You have the right to request an inspection of your data at any time.

2. Change - If you wish to modify, correct, supplement, protect, or delete your data based on the inspection, you can submit a request. Certain details can also be adjusted in your personal account.

3. Objection - You can object to the processing of your data based on a consideration of interests.

4. Data Transfer - If you want to transfer your data to another provider, we will provide it in a structured, commonly used digital format.

5. Withdrawal - If we processed data based on your explicit consent, you have the right to withdraw it. Note that this may impact the services we provide.

To exercise your rights, send a request with a copy of your proof of identity (BSN and passport photo shielded) to info@tulip.art. We will assess your request promptly, within 30 calendar days. If unable to fulfill your request, we will communicate the reasons for rejection.

What can receive your data?

Rest assured, your data is kept confidential and won't be shared with third parties, except when necessary for business operations or compelled by legal obligations. If your data is processed outside the EEA, rest assured that I implement adequate security measures to protect it.

I prioritize your privacy and do not engage in selling your data to external parties.

I can use automated decision-making processes that may impact the availability of certain services based on provided data, actions, or omissions. If you disagree with an automated decision, you have the option to request a reconsideration by a third party.
